These Terms of Service ("Terms") are a binding agreement between you and the operator of RAIN Online ("RAIN", "we", "us") governing your access to and use of the RAIN Online game, website, and related services (together, the "Game"). By creating an account or playing, you agree to these Terms. If you do not agree, do not use the Game.
1. Eligibility
You must be at least 13 years old (or 16 in the European Economic Area / UK) to use the Game. If you are a minor in your jurisdiction, you may only use the Game with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf. You confirm you are not barred from using the Game under any applicable law.
2. Your account
- The Game uses passwordless sign-in. You are responsible for keeping access to your email and any sign-in link secure, and for all activity that occurs under your account.
- One account per person unless we expressly permit otherwise.
- You may not sell, rent, gift, share, or transfer your account, characters, or sign-in access, and you may not buy or accept any of these from others.
- Notify us promptly through Support if you believe your account has been accessed without your permission.
3. License to play
Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to access and play the Game for your own non-commercial entertainment. We and our licensors own all rights in the Game, including its software, art, characters, music, text, names, logos, and other content. No rights are granted except as expressly stated here.
4. Virtual items and purchases
- Characters, cards, currency, cosmetics, levels, and other in-game items and progress ("Virtual Items") are licensed to you, not sold. You do not own them and they have no monetary value outside the Game.
- Virtual Items cannot be redeemed for cash and may not be exchanged for real money or anything of real-world value ("real-money trading" is prohibited).
- We may create, modify, remove, balance, price, expire, or stop offering any Virtual Item at any time, including after a purchase, without liability to you.
- All purchases are final and non-refundable except where a refund is required by applicable law. Where you have a statutory right to a refund, that right is unaffected by these Terms.
- Supporter benefits and subscriptions, if offered, are described at purchase and may be changed or discontinued on reasonable notice.
5. Code of conduct
You agree not to:
- Cheat, use bots, macros, automation, or third-party tools that affect gameplay;
- Exploit bugs, glitches, or errors rather than reporting them;
- Reverse engineer, decompile, scrape, or interfere with the Game or its servers;
- Harass, threaten, defraud, impersonate, or harm other travelers;
- Post unlawful, infringing, hateful, or sexually exploitative content;
- Engage in real-money trading, account sales, or fraudulent payments or chargebacks;
- Use the Game to violate any applicable law or the rights of others.
6. User content
You are responsible for any names, chat, or other content you submit. You grant us a worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and use that content to operate, improve, and promote the Game. We may remove content or reset names that violate these Terms.
7. Suspension and termination
We may suspend, restrict, or terminate your account or access to the Game at any time, with or without notice, including for suspected violations of these Terms, for legal or security reasons, or because we are changing or discontinuing the Game. If we terminate your account for a serious violation, you may lose access to your characters, Virtual Items, and progress without refund. You may stop playing and request deletion of your account at any time through Account.
8. Changes to the Game and these Terms
The Game is a live service. We may add, change, suspend, or remove features, content, servers, or the Game as a whole at any time. We may update these Terms from time to time; material changes take effect when posted, and your continued use after changes means you accept the updated Terms.
9. Disclaimers
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Game will be uninterrupted, secure, error-free, or that progress, items, or data will never be lost.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RAIN AND ITS OPERATORS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, VIRTUAL ITEMS, OR PROGRESS, ARISING FROM OR RELATED TO THE GAME. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE GAME WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless RAIN and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Game, your content, or your violation of these Terms or of any law or third-party right.
12. Communications
We will send you service messages necessary to operate your account (such as sign-in links and important notices). Marketing emails about news, events, and updates are optional; you may opt in during sign-up and unsubscribe at any time using the link in those emails or through Support.
13. Governing law and disputes
These Terms are governed by the laws of the operator's principal place of business, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections of your country of residence. You agree to resolve disputes in the courts located at the operator's principal place of business, except where applicable law gives you the right to bring proceedings elsewhere.
14. Miscellaneous
If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us regarding the Game and supersede prior agreements on that subject.
